Terms of Service

These terms apply whenever you commission a custom portrait from Nicci Sims Art ("I", "me", "my") through this website, email, or social media. By requesting a commission you agree to the terms below. If anything is unclear, please ask before placing an order.

Commissions

Commissions are made to order based on the reference photo(s) and details you provide. I'll confirm the brief, size and price with you before any work begins, and no work starts until that brief is agreed and any required deposit has been received.

Reference photos

You confirm that you own or have permission to use any photo you send me, and that I may use it to create your portrait. Clear, well-lit, high-resolution photos give the best results — I'll let you know if a photo isn't suitable before starting.

Pricing and payment

Prices are quoted before work begins and may vary by size, complexity and number of subjects. A non-refundable deposit may be required to secure your commission slot, with the remaining balance due before the finished piece is shipped or handed over. Accepted payment methods will be confirmed at the time of booking.

Timelines

Estimated completion times are provided as a guide and can vary depending on current workload, the complexity of the piece, and how quickly reference details are confirmed. I'll keep you updated with progress and let you know as early as possible if a timeline needs to change.

Revisions and approval

I'll share the composition and, where appropriate, progress updates for your approval before the portrait is finalised. Reasonable revisions at the sketch/composition stage are included; significant changes requested once colour work is underway may affect the price or timeline.

Cancellations and refunds

If you need to cancel a commission, please let me know as soon as possible. Deposits are non-refundable once work has started, as they cover time already committed to your piece. If you cancel before work begins, any deposit paid may be refunded at my discretion, less any costs already incurred.

Shipping and delivery

Physical artwork is carefully packaged and shipped to the address you provide. Shipping costs and estimated delivery times will be confirmed with you separately and are not included in the commission price unless stated otherwise. I am not responsible for delays caused by the courier or postal service once a piece has been dispatched.

Copyright and usage

I retain copyright over the artwork I create, including the right to photograph and share finished commissions (for example, on this website or social media) for portfolio and promotional purposes. If you'd prefer your commission not be shared publicly, let me know and I'll respect that request. You're welcome to share images of your own finished portrait for personal, non-commercial use, with credit appreciated.

Limitation of liability

Every portrait is created with care, but as original hand-drawn artwork, minor variation from a reference photo is a natural part of the process. To the extent permitted by law, my liability in connection with a commission is limited to the amount paid for that commission.

Changes to these terms

These terms may be updated from time to time to reflect changes to how commissions are run. The version in place at the time you place a commission will apply to that order.
